Microsoft to be heard on Word injunction appeal

Microsoft will have its day in court on Wednesday.

OK, so the software maker still spends lots of days in court, even if it has settled many of the antitrust cases that once filled its Outlook calendar. I4i said Wednesday that it refutes the latest claims made by Microsoft in an XML patent infringement case involving Word.

I4i Chairman Loudon Owen called Microsoft's claims "the same weak defenses Microsoft repackaged from the trial and raised on appeal."

Following its recent appeal, Microsoft was granted a stay of an injunction last week that would have forced the company to stop selling Word in its current form by next month.

Microsoft has been granted a stay of a landmark injunction in a patent infringement case that would have required the software giant to stop selling its popular Word in its current form by next month.

The U.S. Court of Appeals for the Federal Circuit on Thursday granted Microsoft's motion for a stay, pending appeal, of an injunction issued in August by a federal judge that bars sales of Word that include a custom XML code found to infringe on patents held by i4i--the plaintiff.

A judge on Tuesday ordered Microsoft to stop selling Word, one of its premier products, in its current form due to patent infringement.

Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas issued a permanent injunction that "prohibits Microsoft from selling or importing to the United States any Microsoft Word products that have the capability of opening .XML, .DOCX or DOCM files (XML files) containing custom XML," according to a statement released by attorneys for the plantiff, i4i.

Microsoft on Tuesday released its November 2008 security bulletin, including one patch rated "critical."

The critical bulletin affects Microsoft XML Core Services and Internet Explorer, while the "important" bulletin affects Microsoft Server Message Block (SMB) Protocol. IBM to shun 'rogue' standards bodies

IBM thinks it's time to clean up standards bodies.

The computing giant on Tuesday said that it will review its membership in existing standards bodies and withdraw from those that are not sufficiently transparent in their processes and intellectual property practices.

IBM convened a group of experts this summer to diagnose problems in the "standards community." It published the group's findings on Tuesday.
