Galaxy Tab ban: 'Not terribly fair to Samsung'

Samsung's Galaxy Tab may have suffered an injustice in Australia with the imposition of a ban on sales of the tablet there, at least in the eyes of one appeals court judge.

At a hearing today in Sydney in a patent case pitting Samsung against iPad maker Apple, Federal Court Justice Lindsay Foster questioned an October ruling that quashed Galaxy Tab 10.1 sales. Samsung wants to get that decision overturned to avoid what its lawyer called "dire consequences," according to a report from Bloomberg.

"The result looks terribly fair to Apple and not terribly fair … Read more

Carriers, Apple face Samsung scrutiny

Samsung is seeking to obtain the agreements between Apple and Australia's three major mobile telecoms--Optus, Vodafone, and Telstra--as well as the source code for the iPhone 4S firmware as it seeks to block the sale of Apple's newest smartphone.

In a hearing today in the ongoing patent dispute between Apple and Samsung over alleged infringements in the Galaxy Tab 10.1 and Apple's new iPhone 4S, Samsung's counsel told the judge that in order to make its case for an injunction on the sale of the 4S, it needs Apple to produce the agreements that it … Read more

Samsung: Galaxy Tab injunction 'flawed'

Samsung Electronics today alleged that the interlocutory injunction awarded to Apple against the Samsung Galaxy Tab 10.1 was incorrect and a leap of logic, all the while pushing for the case to be expedited in the courts.

In a case presented before Justice Lindsay Foster in the Federal Court of New South Wales today, Samsung contested the basis on which Justice Annabel Bennett gave her ruling two weeks ago.

Samsung complained on multiple grounds. In Bennett's ruling, she said that Samsung's "unwillingness" to move the case to an early final hearing stage counted against the … Read more

Apple wins injunction against Samsung in Australia

Apple won an interlocutory injunction Thursday by the Federal Court of Australia against Samsung and its Galaxy Tab 10.1, which will see the product held off Australian shelves until a full patent case can be heard.

Justice Annabelle Bennett read from a summary judgment text in Sydney, saying she had evenly weighed the balance of convenience to determine which party would be most inconvenienced by a judgment made either way.

Bennett said that if the Tab 10.1 were in fact released while a full patent case was prepared, the damage to Apple would be significant. Likewise, if the … Read more

Ruling on Apple-Samsung spat in Australia coming next week?

Apple will need to wait until Monday at the very earliest to hear whether its request for a preliminary injunction against Samsung's Galaxy Tab 10.1 will be granted in Australia, a new report claims.

According to Reuters, Judge Annabelle Bennett promised a quick decision on the case after lawyers for Apple and Samsung completed their arguments in the Australian federal court earlier this week. Although the attorneys expected a decision today, it appears now that Bennett will use the weekend before making a final determination on the matter.

Apple rejects Samsung's settlement offer in Australia

Apple has rejected a settlement offer from Samsung Electronics that would have allowed the consumer electronics maker to sell its Galaxy Tab 10.1 in Australia.

Apple, which claims Samsung's products copy the look and feel of the technology used in its products, told a federal court in Sydney on Tuesday that the settlement offer had no basis, according to a Reuters report.

"It is one we don't accept and there is no surprise," Apple attorney Steven Burley told the court. "The main reason we are here is to prevent the launch and maintain the … Read more

Neither party divulged the details of the deal.

The legal spat between Apple and Samsung that has stretched around the world took on additional weight this week, with a new claim lodged against Apple by Samsung in Australia.

Bloomberg reports that Samsung this week went ahead with plans to file a cross claim with a federal court in Australia that takes aim at Apple's iPhone and iPad for infringing on seven wireless patents it holds. The claim also aims to invalidate patents held by Apple that have been used against the company, Bloomberg said.

Last month Samsung announced it would be taking retaliatory action against Apple, which … Read more

U.S., Australia to add cyber realm to defense pact

Cyberattacks are about to carry even more weight, with the United States and Australia expected to include them in a mutual defense treaty.

The two nations will declare the cyber realm to be part of the 60-year-old treaty tomorrow, Reuters reports. The inclusion will mean that a cyberattack on one country could lead to a response by both.

"We will be releasing a joint statement saying that the ANZUS treaty applies to cyberspace," Reuters quoted a senior U.S. defense official as saying of the rare move.
